Recent Cases

1. Palermo v. the Town of North Reading

The firm represented the Plaintiff Landowners in an Eminent Domain action against the Town of North Reading. Massachusetts. The Plaintiffs were one of approximately 30 Landowners whose property was taken to establish a passive recreation park. This was the only case of such thirty that went to trial, and the firm obtained a jury verdict in excess of over 13 times greater than the original pro tanto award. The case is now on appeal in the United States Court of Appeals on the question of whether further damages against the defendant town are warranted.

2. Hunter v. Ace Trucking

The firm represents the plaintiff in its claim for damages pursuant to USC. 42 for violation of the Interstate commerce Act while plaintiff was leasing trailers from the defendant while permitting deliveries in Virginia. Trial is pending.

3. Jane Doe v.***** Hospital

The firm presented the Plaintiff nurse in a sexual harassment claim against a major Boston Hospital and a prominent Doctor. After extensive discovery, including the Depositions of the Doctor in Question and other physician s with relevant knowledge the case settled. The case has been sealed by agreement.

4. McCarthy v. ***** Nursing Home

The firm represented and elderly resident of Nursing Home fell in the bathroom adjoin his room, cracking his hip, not being discovered until hours after the fall. The battery powering the strap alarm system designed to restrain the patient in his bed was unchecked, and without power, whereby the resident was allowed to exit his bed without the staff being aware of it. The patient dies several days thereafter. The case settled after filing suit.

5. Stickney v. *******Salem Hospital

The firm represented an elderly Plaintiff was admitted to local hospital to have gall bladder operation. While being prepped for surgery, an intravenous treatment infiltrate beyond the vein, causing significant damage to the hand of the plaintiff. Trial is pending.

6. Smith v. Dr. ********* and **********Hospital

The firm represents the plaintiff, a 50-year-old woman who was diagnosed with breast cancer that later metastasized, resulting in a brain tumor. The evidence suggests that evidence of the cancer was evident in a mammogram and ultrasound performed 13 months prior thereto. Trial is pending.
